Material fact
A fact that would affect a reasonable buyer's decision to buy or the price they would pay.
Known material facts affecting the value or desirability of a property must be disclosed to a buyer whether or not that buyer is the agent's client. This is what makes the duty to a non-client third party real. A death on the property is disclosable within three years, though a direct question must always be answered honestly regardless of the window, and the fact that an occupant had or died from AIDS may not be disclosed.
