How to Answer EXCEPT, NOT, FIRST, and BEST Questions on the California Real Estate Exam

Read the question's task before choosing an answer. EXCEPT asks for the choice outside a stated group; NOT changes the condition you must test; FIRST asks about sequence at the stated stage; BEST asks which option most precisely fits the facts. Rewrite the task in a few words, check all four choices, and then reread the original wording.

EXCEPT, NOT, FIRST, and BEST ask different things

You can know a rule and still answer the wrong question. The problem is often the task: you selected an allowed action when the question asked for an exception, or a valid closing step when it asked what comes first.

EXCEPT

Find the choice outside the stated group.

Three choices fit this rule. Which one does not?

Watch for: Choosing a familiar, correct statement instead of the exception.

NOT

Identify exactly what the question negates.

Which statement is false, or which action is not required?

Watch for: Treating something not required as something prohibited.

FIRST

Find the next necessary step at the stage described.

What must happen before the other listed actions can proceed?

Watch for: Choosing a valid later step or repeating a step already completed.

BEST

Choose the option that most directly answers the stated issue.

Which choice fits the rule and all the relevant facts most precisely?

Watch for: Choosing a true but incomplete fact, or inventing missing facts.

Read the whole condition

“Not required” does not mean “prohibited.” An optional action can be permitted without being mandatory. “Not incorrect” points to a correct statement. Resolve both words before evaluating the choices.

These are reading categories, not additional DRE content areas. DRE does not publish a quota for each wording type. The examples here are original teaching exercises, not recalled or predicted exam questions.

Use the same five-step check on each question

  1. Name the task. Write a short cue on paper during practice: exception, false statement, next step, or most precise explanation. Keep the original condition intact.
  2. Keep the decisive facts. Who is acting? Who is represented? What has already happened? Which amount, period, or legal condition is supplied?
  3. State the controlling concept. Before reading the explanations, name the rule or calculation that applies. If you cannot, the gap may be subject knowledge rather than wording.
  4. Test all four choices. Explain why each fits or fails. For EXCEPT, label the members of the group and the outsider. For BEST, distinguish an answer from a merely related fact.
  5. Check the selected choice against the original stem. Ask whether it satisfies the exact negative, sequence, or requested explanation. This last pass catches answering the opposite question.

Do not turn this into a keyword game. The longest answer is not automatically correct. Words such as always and never may be right or wrong depending on the rule. FIRST does not mean “disclose” in every scenario, and BEST does not override a legal requirement.

Four questions, with the reasoning behind every choice

Write your answer letter and a short reason before opening each review. The choices are a reading exercise, not a scored quiz. After checking the answer, read the changed-fact comparison.

Example 1 · EXCEPT

A true statement can still be the wrong response

For an income property's NOI calculation, all of the following are operating expenses EXCEPT:

  1. Choice A: Property insurance premiums
  2. Choice B: Mortgage principal and interest
  3. Choice C: Property management fees
  4. Choice D: Real property taxes
Review example 1

Answer: B. Mortgage principal and interest

The task: Find the item excluded from operating expenses for NOI.

Do not stop when you recognize insurance as a valid expense. EXCEPT asks for the one item that does not fit.

Choice A
Insurance is an operating expense, so it belongs in the group.
Choice B
Mortgage debt service is excluded from operating expenses when finding NOI. This is the exception.
Choice C
Management fees are an operating expense, so this choice fits the group.
Choice D
Real property taxes are an operating expense. Do not confuse them with an owner's income taxes.

Change the facts or wording: If the question instead asked for the owner's cash flow after debt service, mortgage payments would matter. Changing the requested measure changes which figures belong.

DRE Reference Book, Chapter 15: income and operating-expense analysis, printed pages 414–415

Example 2 · NOT

Keep the negative while checking every statement

A comparable property sells for $360,000 and has gross rent of $3,000 per month. Which statement is NOT correct?

  1. Choice A: Its monthly gross rent multiplier is 120.
  2. Choice B: Its annual-basis rent multiplier is 10.
  3. Choice C: Its monthly multiplier can be applied directly to annual rent.
  4. Choice D: Its gross rent multiplier does not deduct operating expenses.
Review example 2

Answer: C. Its monthly multiplier can be applied directly to annual rent.

The task: Select the false statement, not one of the correct calculations.

Three statements fit the facts. The third mixes a monthly multiplier with annual rent.

Choice A
$360,000 ÷ $3,000 = 120, so this statement is correct.
Choice B
Annual rent is $36,000; $360,000 ÷ $36,000 = 10. This statement is correct.
Choice C
A monthly multiplier must be paired with monthly rent. Applying 120 to annual rent of $36,000 gives $4,320,000, not $360,000.
Choice D
The multiplier uses gross rent rather than NOI, so this statement is correct.

Change the facts or wording: Replace NOT correct with correct. Now three choices qualify, so the revised item would not have one defensible answer. An editor must revise the choices as well as the stem.

Example 3 · FIRST

Read the transaction stage before choosing the next step

In a covered California residential transaction, a buyer's agent is about to execute a buyer-broker representation agreement with the buyer. The statutory agency disclosure form has not been provided. Which listed action must occur FIRST?

  1. Choice A: Sign the agreement, then deliver the disclosure form.
  2. Choice B: Wait for the seller to accept an offer.
  3. Choice C: Send the disclosure form after escrow opens.
  4. Choice D: Deliver the disclosure form before signing the agreement.
Review example 3

Answer: D. Deliver the disclosure form before signing the agreement.

The task: Find the unmet requirement that precedes the agreement.

The stated missing step controls the answer. This does not purport to list every action in an actual transaction.

Choice A
This reverses the required order.
Choice B
Offer acceptance is too late for the agreement-stage disclosure.
Choice C
Opening escrow is too late for this required disclosure.
Choice D
Civil Code 2079.14(a)(2) requires delivery before the representation agreement is executed.

Change the facts or wording: If the form has already been properly delivered and its receipt handled, delivering another copy is not automatically the next step. Read the remaining facts instead of repeating a memorized sequence.

Example 4 · BEST

A relevant fact is not always the answer to the question

A loan is $360,000 and the value specified for LTV is $450,000. Which statement BEST explains the resulting 80% LTV?

  1. Choice A: The loan is 80% of the stated property value.
  2. Choice B: The stated property value is $450,000.
  3. Choice C: The value exceeds the loan by $90,000.
  4. Choice D: The loan's annual interest rate is 80%.
Review example 4

Answer: A. The loan is 80% of the stated property value.

The task: Explain what the ratio measures, not just repeat a supplied amount.

The second and third choices are true facts. The first is better because it answers the precise question.

Choice A
$360,000 ÷ $450,000 × 100 = 80%. This directly explains the ratio.
Choice B
The value is correctly restated, but that alone does not explain LTV.
Choice C
The $90,000 difference is correct, but the question asks what the 80% loan-to-value ratio means.
Choice D
LTV measures loan relative to value; it is not an interest rate.

Change the facts or wording: If the question instead asked for the dollar difference between value and loan, the third choice would answer it. The facts remain the same; the requested result changes.

Try two fresh problems without looking back

The first changes what has already been calculated. The second changes the negative. Explain your choice before opening the feedback. Two answers are not evidence of exam readiness; use them to identify the step to review.

Self-check 1 · FIRST

Do not repeat a completed step

An analyst has already verified annual NOI of $72,000 and selected a 6% capitalization rate. To calculate indicated value by direct capitalization, which listed calculation should the analyst perform FIRST?

  1. Choice A: Subtract operating expenses from NOI again.
  2. Choice B: Divide $72,000 by 0.06.
  3. Choice C: Multiply $72,000 by 0.06.
  4. Choice D: Divide potential gross income by 0.06.
Review self-check 1

Answer: B. Divide $72,000 by 0.06.

The task: Use the verified inputs rather than restart the analysis.

FIRST depends on the stage described. Here, NOI and the rate have already been determined.

Choice A
NOI already reflects operating expenses; subtracting them again double-counts them.
Choice B
$72,000 ÷ 0.06 = $1,200,000. Both required inputs are already available.
Choice C
Multiplication gives $4,320, not the indicated value.
Choice D
Potential gross income is not the NOI input for this calculation.

Change the facts or wording: If only potential gross income, vacancy losses, and expenses were supplied, determine NOI before capitalizing it.

DRE Reference Book, Chapter 15: capitalizing annual NOI, printed page 415

Self-check 2 · NOT

Resolve a double negative before calculating

For a loan of $240,000 and a stated property value of $300,000, which statement is NOT incorrect?

  1. Choice A: The LTV is 125%.
  2. Choice B: The LTV is 20%.
  3. Choice C: The LTV is 80%.
  4. Choice D: The LTV is 8%.
Review self-check 2

Answer: C. The LTV is 80%.

The task: NOT incorrect means correct in this exercise.

The double negative changes the target. Do not select a false statement merely because you saw NOT.

Choice A
125% comes from reversing value and loan.
Choice B
20% is the difference as a share of value, not the loan's share.
Choice C
$240,000 ÷ $300,000 × 100 = 80%, so this statement is correct.
Choice D
8% misplaces the decimal in converting the ratio to a percentage.

Change the facts or wording: With NOT correct instead, three statements would qualify. That wording would require different choices to make a valid single-answer item.

Give careful reading a place in your pacing plan

The salesperson exam has 150 questions and a three-hour time allowance. That averages 72 seconds per question, not a fixed time limit for each one. Some items will take less time, leaving room for those that need a closer read.

If you are stuck between two choices, name the difference between them. Is one a later step? Does one use annual rent where monthly rent is required? Does one state a correct fact but leave the requested ratio unexplained?

If you still cannot resolve the issue, do not let one item consume the time needed for the rest. Use any review controls according to the testing interface and proctor instructions. On a practice set, record why you were uncertain before opening the explanation.

DRE Taking the Exam: salesperson time allowance and four-choice format

A review note that helps next time

  • Wording: “I chose an operating expense when EXCEPT asked for the excluded item.”
  • Sequence: “I restarted the NOI calculation even though NOI was already supplied.”
  • Subject knowledge: “I did not know when the agency disclosure form was due.”
  • Calculation: “I divided value by loan instead of loan by value.”

Use the note to choose your next task. A wording miss needs deliberate rereading; a rule gap needs the underlying lesson. Changing a label alone does not fix both.

Official sources and what they support

DRE sources establish the exam format and broad content scope. The law publication and appraisal reference support the teaching examples. The reading method is editorial guidance, not a DRE-endorsed technique or a proven score improvement.

Frequently asked questions

How do I answer EXCEPT questions on the California real estate exam?

Identify the stated group or rule, then check each option against it. In a single-answer EXCEPT item, select the one choice that does not fit. Before submitting, confirm that you have selected the exception rather than a correct member of the group.

Does NOT always mean I should pick a false statement?

No. Read what NOT modifies. NOT correct asks for a false statement; NOT required asks for something not mandatory, which may still be permitted. NOT incorrect reverses the target again. Rewrite the full condition without changing its meaning.

How should I approach FIRST questions?

Identify what has already happened and which necessary step remains. Do not select a later action merely because it is valid, or repeat a step the facts say is complete. Timing rules and calculation prerequisites can determine the answer.

What does BEST mean in a multiple-choice question?

Choose the option that most precisely answers the stated issue under the given facts. A true but incomplete or irrelevant statement may be weaker. BEST does not allow you to disregard controlling law or invent facts that make a preferred choice work.

Should I choose the longest answer or avoid words like always?

No. Answer length and words such as always or never are not reliable substitutes for knowing the rule. Test the actual statement against the facts and any applicable exceptions. Use evidence rather than a guessing slogan.

How many EXCEPT or NOT questions will DRE include?

DRE's published content outline and sample-question document do not specify a quota for these wording types. These exercises teach careful reading, not a forecast of the exact wording or mix on your exam.

How much time should I spend on a difficult question?

The salesperson exam allows three hours for 150 questions, averaging 72 seconds per question. That is a pacing reference, not a limit on each item. Avoid letting one difficult question consume time needed for the rest, and follow the testing interface's review instructions.

How can I tell whether I missed the wording or the subject?

After answering, explain both the task and the controlling concept without looking at feedback. If you knew the rule but answered its opposite, review the wording. If you cannot explain why the choices fit or fail, review the subject as well.
