Practice and Disclosures, 25% of the examination
Broker supervision
The responsible broker's duty to exercise reasonable supervision over licensed activity performed under the broker's license.
Reasonable supervision includes policies, training, review of documents, advertising oversight, trust-fund controls, and familiarity with the work being performed. A salesperson's independent-contractor status for tax purposes does not remove the broker's regulatory responsibility.
Test the distinction
A relevant question from Practice and Disclosures, selected because its facts or explanation use this concept.
Who is responsible for supervising a salesperson's compliance with the Real Estate Law?
Written to DRE's published topic list. Not a real examination question, since reproducing those is a misdemeanor under B&P Code section 123.
