Implied warranty of habitability

The landlord's nonwaivable duty to provide and maintain residential premises fit for human occupation.

Habitability concerns core health and safety conditions such as weather protection, plumbing, heat, electrical systems, sanitation, and legally required facilities. It differs from a cosmetic preference or a repair obligation created only by the rental agreement.
