Implicit bias
Automatic associations that can affect judgment and service even without a conscious intent to discriminate.
For examination applications received on or after January 1, 2024, DRE requires a qualifying Real Estate Practice course that includes implicit-bias content and the application of federal and state fair housing law. The fair housing component must include interactive role-play from both the consumer and real estate professional perspectives. In practice, the useful response is operational: use consistent questions, criteria, follow-up, property access, and documentation rather than assumptions about a consumer.
